Our terms and conditions are set out below. They do not affect your statutory rights.

Who are we?

"Kit Designer", "Rugby Kit Designer" and "Football Kit Designer" are trading names of Cardigan Sand & Gravel Company Limited, a family firm established in 1959. We have been producing high quality fabrics and garments for over 15 years. Our company number is 631623 and our VAT registration number is 122 141 333.

All references to the "Website" below shall include reference to all URL's (websites) owned by Kit Designer.

Orders

When you place an order with us, we will send you an "Acknowledgement Email" noting receipt of your order and confirming the details of your order. Your order is formally accepted when we send a "Confirmation Email" email to you confirming that the products are available and in stock, and the dates that they are due for dispatch, and delivery.

How can I pay?

We accept payment for orders via online transaction (through Protx secure server), BACS transaction, and postal orders by cheque. All credit/debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Maestro and Switch.

What if my card issuer doesn't authorise payment?

We cannot accept or process any credit/debit card orders without an authorised valid card payment in the name of the registered cardholder.

Product Photos

Photographs, measurements and other means of describing the products on the Website shall be as accurate as possible, but please note that the products may be subject to slight variation in manufacture from time to time.

Prices

All prices are shown in pound sterling (£). We try to offer goods at the most reasonable price possible, however, if, due to circumstances beyond our control, we need to alter any advertised price, we reserve the right to do so without prior notice.

Although every effort is made to ensure that prices published on the Website are accurate, errors concerning price may occur from time to time. All prices quoted on the Website include VAT, unless otherwise stated.

From time to time, we may make certain products available on the Website at a special discounted price. If this is the case, the price will be clearly marked as a "special offer" and the conditions specific to that offer (i.e. duration of the special offer price, etc) will be stated directly next to the description of the products concerned.

If after you have placed an order with us, we find an error concerning the price of any of the products you have ordered, we will notify you as part of our order confirmation procedure and shall give you the option to either:

  1. re-confirm your order at the revised price; or
  2. cancel your order by email or letter.

If you fail to inform us of your decision within seven working days from the date of our email, your order shall automatically be cancelled (please see the section on "Cancelling an Order" below for further details on how you will be reimbursed).

Delivery

Once we have received full payment in cleared funds, we will dispatch your product for delivery.

Items ordered will be delivered as soon as possible in accordance with the requested delivery service. All delivery charges shown are for next day delivery of items in stock, to U.K. mainland only.

Delivery conditions and charges may be subject to change without prior notice. We usually deliver our products by courier but may (at our discretion) use Royal Mail.

Where will you deliver to?

We deliver to anywhere in the world, but destinations outside England, Scotland and Wales will incur a greater postage cost. You will be informed of this when ordering.

What if an item is out of stock?

All goods are subject to availability. If we expect to be unable to supply your goods within 28 days, we will inform you immediately and advise you by email of the expected delivery date, or offer details of a substitute product of equivalent quality and price. You may then either:

  1. reconfirm your order on the revised basis; or
  2. cancel it. Cancel by emailing (i) your order reference number, (ii) the products you ordered, and (iii) (where appropriate) the delivery date.

If you do not inform us (by email or letter) within seven working days from the date of our email, your order shall automatically be cancelled. Please see the section on "Cancelling an Order" below for further details on how you will be reimbursed.

What if the goods are faulty or damaged when they arrive?

We hope it never happens, but if it is then you need to inform the courier and inform us, in writing via post or email, within seven working days of receiving the goods, providing us with the following information:

  1. your order reference number;
  2. details of the defective product(s) and description of the fault
  3. the delivery date.

We will then arrange for the defective products to either be returned by you or be collected by us or a third party on our behalf, at our own cost. We will then either:

  1. replace the defective products (if we have replacement items in stock, they will be replaced within seven working days of us receiving them. If the replacement items are not in stock, such as items requiring bespoke construction or customisation, we will let you know when we will be able to replace them by); or
  2. cancel your order and reimburse you for the price paid for the defective products. Please see the section on "Cancelling an Order" below for further details on how you will be reimbursed.

What if there are some items missing?

If the order is short then you need to let us know in writing or by email within seven working days of receiving the goods.

What if it's late?

We will always try to deliver to time, but we reserve the right to delay delivery when this is due to circumstances beyond our control. In the unlikely event of this happening, we will inform you by email.

Guarantees

All products offered are guaranteed to arrive in good condition. We can only offer a refund for unwanted goods for seven working days after receipt. In the event of a claim, please return the products with a copy of the original invoice to: Kit Designer, 41-45 Richmond Terrace, Carmarthen, Carms. SA31 1HG.

Please clearly identify the problem with the item. All items must be returned in the same condition they were received in.

What is my proof of payment?

An invoice marked 'paid' will be dispatched to you for all purchases. This is your proof of payment and also your guarantee.

Cancelling an Order

How do I cancel an order?

Let us know as soon as possible by email, telephone or writing to us, quoting your order number. Where goods are being made to your specification (e.g. custom colours, names, numbers, badges or logos) then they cannot be cancelled once production has started.

But I have already paid!

Where payment has already been made, we will give an alternative or refund in full for the item(s) concerned. In the event of any goods delivered by us being damaged in transit, or failing to match the items ordered by you, then such details must be notified by you to us within seven working days of receipt. If you do not so notify us, we will deem you to have accepted the items as satisfactory.

Returns

What if I change my mind after ordering?

If the items are not customised, if you wish to return an item for exchange or you have decided not to keep it, please contact us within seven days of receipt of item. Returned items must be accompanied by a copy of your paid invoice and be accompanied by original packaging. You should arrange for a return courier where possible. After we have established that the item is unused and undamaged, you will be refunded the entire sales price excluding original cost of delivery, and if applicable, the cost of return service, within seven days. All goods must be complete with original packaging. If you are in any doubt, please contact us.

What, even customised items?

If customised items are faulty, you may of course return them. If there is no fault with the goods, then all goods that have been made to your specifications or have been clearly personalised are except from the right to a refund.

Complaints

What do I do if I have a complaint?

Any complaint can be communicated directly to Kit Designer, by email to info@kitdesigner.co.uk, or by letter to Kit Designer, 41-45 Richmond Terrace, Carmarthen, Carms. SA31 1HG. We will try to deal with your complaint within five working days of receiving it. If we can't resolve your complaint immediately we will let you know how long we think it will take, and will keep you informed of any investigation.

Legal Information

All contracts shall be governed by and construed in accordance with English Law and any dispute between us will be resolved exclusively in the courts of England and Wales. By using this site you are agreeing to these terms and conditions. All transactions with Kit Designer will be governed by these terms and conditions.

These terms and conditions form the entire agreement between us.

A person who is not a party to these terms and conditions has no right to enforce any term of them under the Contracts (Rights of Third Parties) Act 1999.

All references to the 'company', 'us' or 'we' refer to Kit Designer. All references to 'customer' or 'you' shall mean the person or persons purchasing or agreeing to purchase goods from the company. All references to the 'Website' shall include reference to all URL's owned by Kit Designer.

Copyright

All content, text, photos, images published on the Website are owned by us and cannot be reproduced without our prior written consent.

Liabilities

  1. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and/or non-delivery of your order.
  2. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the company's appointed carrier. Liability in such cases is limited to the value of those items, which are shown to have not been received by the customer.
  3. We will not be liable for non-performances of our obligations caused or resulting from industrial disputes or any other circumstances beyond our reasonable control. If by reason of such circumstances it shall become impossible within a reasonable time for the company to wholly or partly supply the items ordered then the customer's liability will be limited to the value of the items already supplied together with any associated delivery charges.
  4. Any information displayed on our Website or other printed matter by the company is not regarded to be authoritative or certified as the best practice and is only considered to be useful supplementary advice to other certified codes of practice. All information on our Website is updated regularly.
  5. Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions. We reserve the right to alter our prices and specifications without notice.
  6. We do not exclude or limit our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation or for our breach of a statutory duty.
  7. All other damage or loss incurred by you as a result of your use of the Website and/or your use and/or purchase of our products shall be limited to the greater of £100 or the price paid for the defective products in question.
  8. We will not be liable for any damage or loss (including fair wear and tear) caused by you or any third parties, other than our courier.

Ownership of Goods

All items supplied to the customer remain the property of Kit Designer until final payment of all sums owing in respect of those goods has been received in full by us.

Privacy Policy

This privacy policy covers Kit Designer, its Website, and any other method of selling used by us.

You can browse our site(s) without disclosing any personal data to us. Any links to third party web sites are covered by the third parties privacy policies.

We will collect and store information about you to allow us to firstly, process and fulfill any order requirements and secondly to provide you with the best possible service. We will collect and store any personal data that you may volunteer whist using our services (e.g. registration or placing an order). All information is collected lawfully and in accordance with the Data Protection Act 1998.

The information and data collected will only be used for the purposes of processing your order and marketing our products to you. We will never pass it on to anyone else for any other purpose. We will keep your information and data on our records for a period of 5 years, after which point such records shall be destroyed.

When purchasing products from us, you will be asked in the order form to confirm that we may occasionally email you with details of our products that we think you might be interested in. By ticking the box, you are confirming that we can email you for marketing purposes. Please note that you may unsubscribe from receiving our marketing emails at any time by emailing info@kitdesigner.co.uk.

Access to information

We will aim to always hold accurate and up to date information about you. You can gain access to information that we may hold about you by writing to Kit Designer at Kit Designer, 41-45 Richmond Terrace, Carmarthen, Carms. SA31 1HG.

We will provide you with a readable copy of any personal data that we may hold about you, within thirty days of receipt of your request. We will require proof of your identity before releasing any data. We will provide the information at a charge of £10.00 payable with your request (this charge covers our administration expenses of retrieving the information).

In instances where you find information that we hold about you to be inaccurate we will correct or delete it promptly, and, at our discretion, refund the charge.

We reserve the right to refuse to provide a copy of any personal data held, but will give reasons for our refusal (this will usually be that the proof of identity provided is inadequate).
